Co-Founding partner Alex Acain Jr. is known throughout the aviation industry in Europe, Middle East and Africa for his aviation law practice. He negotiated various commercial aviation contracts involving narrow-body Airbus A320/21 NEO, Boeing 737 Max, and Embraer 195-E2 Aircraft Purchase Agreements including a broad range of cross-border, high-value aircraft finance transactions, operating Leases, Sale and Leasebacks, pre-delivery payment financings and secured loan transactions. He has also advised international law firm JonesDay on matters about Philippine Internet Technology and Telecommunications. 

He is an experienced negotiator and having acted as General Counsel for a National Airline in the Middle East where has advised and represented the Airline in its dealings pertaining to Operating Lease Agreements and Sale and Leaseback transactions with various Commercial Aircraft Lessors such as GECAS, AerCap, CDB, ICBC, BOC, SMBC, AirCastle, Nordic Aviation Capital, BBAM, Avalon, Jackson Square Aviation, and Macquarie AirFinance  and has worked together with top aviation law firms in the world  concerning operating lease agreements and sale and leaseback transactions. He has advised and negotiated Purchase Agreements with Aircraft Manufacturers such as AIRBUS, EMBRAER, and BOEING  for and on behalf of a national airline in the middle east for the purchase of narrow-body commercial aircraft in billions of US Dollar transactions. Alex has also negotiated various commercial Aircraft Wet Lease transactions and Capacity Purchase Agreements and has worked with Commercial Air Transport Operators and Wet Lease Operators worldwide such as Bulgaria Air, Small Planet, SmartLynx, and Olympus Airways.
In the Philippines, he focuses on civil and family law, intellectual property, criminal law and cybercrime, and immigration litigation. He is also specialising in the complex corporate and transactional legal services and experienced in managing complex transactions on Aviation, Technology, and Intellectual Property. He has more than 20 years of experience in various types of litigation and has handled transactions and controversies involving local and international corporations and has represented foreigners who have pending cases in immigration and the Courts. He has represented companies in Europe, India, Middle East and the Maldives in handling cross-border commercial transactions and having represented international corporations in international business transactions.
Alex is also experienced in negotiating Ground Handling Agreements for and on behalf of an Airline and has dealt with various Ground Handling companies such as Swissport and National Aviation Services in a wide range of aviation contracts for the European locations, India and the Middle East Region. He has also dealt with and negotiated with various General Sales Agency companies like Dnata about General Sales Agency Agreements for airline outstations worldwide.
Alex also established HUMA Aviation Philippines in 2010 which currently owns and operates a fleet of Seaplanes such as Cessna Caravan 208, Cessna 206 G and Cessna 180. He also led the acquisition of Subic Seaplane in 2015.  In 2016, he also assisted Kuwait National Airways (Wataniya Airways-Kuwait) regain and recover its Air Operator Certificate with Kuwait Directorate General of Civil Aviation.

RECENT REPRESENTATIVE EXPERIENCE

  • Represented UIHG/Golden Falcon Aviation - Kuwait in relation to the U.S. $2.7 Billion Purchase Agreement with AIRBUS for 25 A320 Neo Aircraft for Kuwait National Airways (Wataniya Airways) in the Middle East.
  • Represented UIHG/Golden Falcon Aviation in relation to the U.S. $630 Million Purchase Agreement with EMBRAER for 10 E195-E2 Jets for Kuwait National Airways (Wataniya Airways) in the Middle East.
  • Drafted the various Operating Leases between UIHG/Golden Falcon Aviation and Wataniya Airways for a fleet of E195-E2 Jets.
  • Represented UIHG/Golden Falcon Aviation in negotiating for the various Operating Leases with ICBC Leasing for a fleet of E195-E2 Jets for Wataniya Airways. Stephenson Harwood, Hong Kong Office represented ICBC/Sky High Leasing in the negotiation.
  • Represented UIHG/Golden Falcon Aviation - Kuwait in negotiating for the various Operating Leases with AerCap for a fleet of E195-E2 Jets for Wataniya Airways.
  • Drafted the Operating Lease Agreement between Wataniya Airways and Bulgaria Air for a fleet of A319-100 Aircraft.
  • Drafted the Wet-Lease Agreement between Wataniya Airways and Olympus Airways for a fleet of A319-100 Aircraft.
  • Drafted the Wet-Lease Agreement between Wataniya Airways and SmartLynx Airways for a fleet of A320-200 Aircraft.
  • Represented UIHG/Golden Falcon Aviation - Kuwait in negotiating for the various Operating Leases with Air Arabia for a fleet of A320-200 Aircraft for Wataniya Airways. Clyde & Co. and Clifford Chance represented Air Arabia and Dubai Islamic Bank, respectively in the negotiation.

PAST REPRESENTATIVE EXPERIENCE

  • Represented a Japanese debit card company establish an offshore company in the British Virgin Islands and set up a payment gateway facility in Budapest, Hungary for online payment transactions.
  • Represented a company in Budapest, Hungary in various transactions such as the Purchase Agreement, Construction and Real Estate Development of high-end vacation houses in Levél, Győr-Moson-Sopron, Hungary.
  • Represented a company in the Maldives in the long-term lease agreement with the government of Maldives for the development of a high-end resort hotel and spa in Vodamulla, Atol in the Maldives.
