The New Rule for the Declaration of Absolute Nullity of Void Marriages and Annulment of Voidable Marriages took effect on March 15,2003. This is now the controlling procedure for dissolution of marriages. The most important amendment to this Rule is that Appeal by the Solicitor General of the Decisions from the Regional Trial Court is not mandatory.

I have an inquiry.
I am separated from my wife for almost two (2) years (jan. 5, 2005).
Now, i am living with my girlfriend for a year. During this time, i found out that my ex-wife was married before my marriage. I have an NCSO copy of her previous marriage (Dec. 1994).
I would like to file for nullity. Please advice me what to do.

I would like to inquire if my marriage can be declare as null and void since we contracted the marriage under age am 16 years old and 5 months while she was 17 years old and 4 months. Although our parents consented it.
I am separated from her for almost 10 years from now.
She is now living with third party and currently 6 months pregnant.
What are the procedures that we need to do.

Me and my wife are not legally separated nor our marriage was annulled. But we didn’t leave under one roof due to our incessant quarrelling. We both have a jobs. I am the one who left our house, 3 mos ago. I am supporting my family financially by sending it through my wife’s bank account.
Lately, I learned that my wife is seeing another man. Sometimes, she would arrived home late at night. A neighbor told me that this man would sometimes visit our house and have his meals their.
With the present situation, do I have the right to evict my wife from our domicile and return back home and with my 17 & 14 year children be under my custody?

hi. i am 24 and I have been secretly married for almost a year now(nov 2007). I am not living with my husband since 2 weeks after the marriage i found out he was having an affair with another woman and he also refuses for us to live together and just a month after the marriage he never answer my calls. Even before and after the marriage i noticed some changes in him like constant change of mind.

in 1975 ay nagpa civil marriage po kami ng bf ko not knowing na may previous marriage pala siya in 1973 pero di rin po kami nagsama.
nagka bf ulit ako and we seek a legal advice and thru his approval or go signal knowing my first civil marriage was automatically null and void nagpacivil marriage ulit ako in 1979 but this 2nd marriage was then terminated in august 2007 by a court declaration of presumptive death.
ngayon po ay nagpacivil marriage ulit ako sa isang US citizen a filipino based in CA. inaasikaso ko na po yung mga documents ko ngayon in preparation sa filing ng spouse petition sa akin to US. i am worried na baka madelay or madisapprove yung petition dahil may record pala ang first marriage ko sa NSO. makaapekto ba sa spouse petition ang record sa NSO ng frist marriage ko? ano po ba ang dapat kong gawin?

I would like to file for annulment but I see a ray of light with filing for nullity of marriage.
We paid a fixer to marry us in Quezon CIty Hall. We were married the same day and I got the marriage certificate with NSO seal from City Hall the next day.
I wonder if I can file for nullity. We did not file for a marriage license at all. All I have is a marriage certificate.
Please advice me.
