Rights of women under Republic Act 9262

Republic Act No. 9262, otherwise known as “Anti-Violence Against Women and their Children Act of 2004″, has for its purpose the protection of family members; particularly, women and childred, from violence and threats to their personal safety and security.
As defined by the statute, “Violence against women and their children” refers to any act or a series of acts committed by any person against a woman who is his:
a) wife,
b) former wife,
c) a woman with whom the person has or had a sexual or dating relationship,
d) a woman with whom he has a common child, or
e) against said woman’s child, whether legitimate or illegitimate, within or without the family abode,
which result in or is likely to result in physical, sexual, psychological harm or suffering, or economic abuse, including threats of such acts, battery, assault, coercion, harassment or arbitrary deprivation of liberty. It includes, but is not limited to, the following acts:
1. Physical Violence;
2. Sexual violence;
3. Psychological violence; and
4. Economic Abuse.
The aggrieved party may institute the appropriate criminal complaint against the offender by preparing a complaint-affidavit, which details the factual elements of the offense, and file the same with any prosecution office where any of the elements of the offense have been committed.
Upon application, the aggrieved party may likewise avail of a Protection Order, which is a relief granted for the purpose of safeguarding the victim from further harm, minimizing any disruption in the victim’s daily life, and facilitating the opportunity and ability of the victim to independently regain control over her life. The Protection Order may be filed before the Barangay or the Regional Trial Court.









i want to seek advise on what to do with my marriage. i am 3 years separated with 3-year-old daughter. my supposed to be husband is very inconsistent in giving financial assistance, i can just count on how many times he had. please give4 me information on how and what should i do with this because it is a very big burden to me financially. thank you

My husband was hitting me and he was alcoholic and dont have time with me and my kids and he has also 3rd party before for almost 1 1/2 yaers..since i want to get out of this marriage now…i want to file an annulment?what will be my grounds and how much will it cost me since i am here in abroad now.I told him already that i dont love him anymore and i want to be free but he dont want to.so the only thing i know in order for me to be free and legal is to file annulment..please help
I am 5 years separated to my husband and we have only one child and he is now living w/his a mistress w/ one child..I already filed for the concubinage case against them and RA 9262 for the financial support for my daughter…
My evidence is a picture from the friendster account of his mistress and the birth certificate of the their son..Is it enough evidence to prove that their are concubine???Cause I went to their village but no one seems want to help me, according to them there are living together and their neighbors know that my husband and his mistress are married in the other provinces..That’s why i request for the cenomar for the confirmation..
I already talk to their President of the homeowners of their village but she refuse me to give info about their members in the association..She told me that it may conflict their association if she will give an info about my husband and his mistress
What else should i do to prove that there is a concubinage b/in my husband and his mitress?
Is the picture and the birth certificate of his son w/his mistress is not enough evidence to proven that there is a concubinage between them???
Plz help me…
